Dispute Resolution Case Law Update: The English High Court grants a novel anti-suit injunction requiring the withdrawal of an abusive claim made against an expert witness in a foreign court
The High Court recently granted an anti-suit injunction in highly unusual circumstances where foreign proceedings had been brought against an expert witness in his home jurisdiction. In developing this area of the law, Mrs Justice Bacon noted whilst there was no case where an anti-suit injunction has been sought on facts comparable to the present case, she had no hesitation in concluding that an anti-suit injunction should be granted.
