Case Summary
The Supreme Court has handed down a long-awaited decision in relation to the “Quincecare duty”. The claimant, an individual who gave clear and unambiguous instructions to pay monies to a fraudster as part of an “authorised push payment” (“APP“) scam, did not convince the highest court that her bank owed her a duty not to make the payments requested. Lauren Pardoe, a Partner in RK’s Dispute Resolution team, discusses the decision.
